Usage of the services and contents provided by notre.guide implies that the user automatically and unconditionally accepts the terms and conditions defined below. These General Conditions are applicable to all active or passive use of the notre.guide service, as soon as they are posted. notre.guide reserves the right to change these general conditions at any time, without prior notice or compensation. The version of the General Conditions applicable to the service is the one in force at the time of registration or renewal of the service by the customer.

Intellectual property

The whole content of the notre.guide website, including texts, imagines, photos, logos and databases, is protected by the French and international regulations related to intellectual property, in particular copyright and related rights, and brands' rights. By browsing this site, the user recognises that the data composing it are legally protected, and that it is prohibited to extract, re-use or reproduce all or part of the site or its contents. Any usage of elements of the site without the prior express agreement of the rightsholders is not authorised. In the event of any breach of these compulsory provisions, the offender will be subject to statutory legal and civil proceedings.

Personal data protection

notre.guide respects the user's personal data. The personal information collected when creating an account or performing a transaction are for the sole use of notre.guide and the partner concerned by the transaction in question. Their use is limited to the specific processing of the transaction. None of these data are sold, given, assigned or exchanged. In accordance with the French Data Protection Law (loi informatique et libertés) No. 78-17 of 6 January 1978, the user has the right to access and rectify the collected personal data. Data processing relative to the files of the notre.guide system has been declared to the CNIL (French data protection organisation) under number 1089308. User accounts

To access notre.guide's more advanced features beyond simple consultation, users must register by creating a user account. The information provided upon registration must be accurate and complete. The user may update their personal information at any time via the form linked to their account. The user has sole responsibility for protecting their password, which they must not disclose to anyone. If the user forgets their user ID, they may request that a new password be sent by email to the email address associated with their account. notre.guide reserves the right to suspend or close any user account deemed to be in breach of the general conditions or liable to cause a dispute.

Digital welcome booklets

notre.guide enables professionals to set up a digital welcome booklet for their accommodation under the notre.guide brand. Publication of a welcome booklet starts on the effective date of payment for the duration chosen by the manager. At the end of the publication period, there is no automatic renewal. Managers wishing to renew have to log in to their management area in order to extend or re-activate the publication of their digital welcome booklet. The manager has sole liability for the content or absence of information in the digital welcome booklet, which the manager distributes through notre.guide. notre.guide shall not be held liable in the event of any complaints regarding a product not matching the content of the related welcome booklet. The manager is responsible for distributing the digital welcome booklet to their customers. Distribution is only permitted for customers who have already made a booking at the establishment, as the digital welcome booklet is in no way a promotional tool. The service provided by notre.guide is limited to publication of the digital welcome booklet and the related management system.

Technical limitations

notre.guide is accessible 7 days a week, 24 hours a day, except in cases of force majeure and maintenance windows. Despite the precautions taken by notre.guide when supplying services on this site, Internet mechanisms may sometimes affect its functioning. notre.guide is not responsible for the page download speed, any alterations that may occur during the download process, any suspension or interruption of the service, site access times, or any difficulties encountered by the user when consulting the site. It is expressly agreed that notre.guide cannot be held liable for any damage linked to connection to or use of the site, nor for any display problems linked to browser versions not supported by notre.guide. In the event of notre.guide being directly responsible for a malfunction of the service, notre.guide undertakes to implement the necessary resources and measures to ensure that the service is restored as soon as possible.

Despite the care taken over processing information, notre.guide cannot guarantee the exactness, accuracy or completeness of the information provided on this site. Consequently, notre.guide accepts no responsibility for any inaccuracy, inexactitude or omission relating to the information available on this site.

Miscellaneous provisions

The nullity, in whole or in part, of any of the provisions of these General Conditions, under a legal or regulatory provision or a court decision that has become final, does not void the other provisions or the part of the provision not vitiated by nullity. No tolerance by notre.guide can be interpreted as a waiver of the rights and obligations resulting herefrom.

Applicable law and jurisdiction

The present conditions are governed by French law. Users accessing the site from abroad accept unreservedly that they shall be subject to French laws during any activity on this site. The French courts have sole jurisdiction over any dispute concerning the interpretation of these conditions.
